Driving Under the Influence (DUI) in Maryland means “substantial impairment,” which can be proven “per se” with evidence of a blood alcohol content of .08.
Driving While Impaired (DWI) can be presumptively proven with a blood alcohol level of .07, and this may be rebutted.
When Driving Under the Influence of drugs or alcohol, drugs can be quite difficult for the prosecution to prove. With respect to illegal, or prescription, drugs, the drugs found on, or near, the individual charged. There may be a police officer who is trained as a drug recognition expert who observes the alleged offender and testifies regarding his opinion.
Penalties for the various drunk/drugged offenses range from a maximum of 60 days in jail and a $500.00 fine to far more severe maximum penalties.
