Driving Under the Influence (DUI) in Maryland means “substantial impairment,” which can be proven “per se” with evidence of a blood alcohol content of .08.

Driving While Impaired (DWI) can be presumptively proven with a blood alcohol level of .07, and this may be rebutted.

When Driving Under the Influence of drugs or alcohol, drugs can be quite difficult for the prosecution to prove. With respect to illegal, or prescription, drugs, the drugs found on, or near, the individual charged. There may be a police officer who is trained as a drug recognition expert who observes the alleged offender and testifies regarding his opinion.

Penalties for the various drunk/drugged offenses range from a maximum of 60 days in jail and a $500.00 fine to far more severe maximum penalties. This will depend greatly on the number of prior convictions the individual may have, and circumstances such as involvement in an accident with injury to oneself or another, and property damage.

In addition to fines, and incarceration, upon conviction, the individual will have points assessed to his/her driver’s license which will be sufficient to revoke or suspend their driver’s license. If the individual blows over a .08 or refuses to submit to a lawfully requested test offered by the arresting officer, the individual may face severe consequences regarding his/her driver’s license.
